Purchase Process - How do we buy this boat without a broker?

We purchased Mimi directly from her original California-based owners in 2012 - without the use of a broker - while the boat was physically in St Lucia in the Caribbean. The process we followed was very straightforward, resulting in both parties – buyers and sellers – feeling secure during the entire transaction.

The owners had advertised Mimi on one of the for-sale-by-owner sailboat websites, which is where we discovered her during our Google-based searches. Prior to this, we were working with a Miami-based broker, and had travelled to the Caribbean twice, only to be disappointed by the catamarans we were shown.

We had several email-based and phone-based conversations directly with the owners, which eventually led to price negotiations over the next two weeks.

We then contacted a Marine Service center (www.marineservicecenter.com) in Charlotte, NC, which agreed to assist us with the purchase transaction. They had an existing relationship with a legal service that provided the escrow account services to handle the deposit and full payment using financial wire transfers between the parties. They also provided a Buyer’s Order agreement, which we completed with purchase details and buyer / seller signatures, and had notarized.

With a signed Buyer’s Order in place, we (the buyers) transferred our 10% deposit into the escrow account, provided proof-of-funds (recent savings account statement from our bank) for the remaining balance, and the Marine Service confirmed with the sellers.

A professional surveyor was located (internet search) in St. Lucia, and contracted to perform a full in-water and out-of-water survey of Mimi, along with a sea trial. A copy of his report is attached here.

After the satisfactory review of the pre-purchase survey report, a closing date was arranged. Several days prior to the closing date, we wired the remaining payment balance to the escrow account, and the Marine Service confirmed this balance with the sellers.

On the closing date, buyers and sellers met at the boat, handed over the keys, and placed a call to Marine Services to perform the wire transfer of all funds to the seller’s account. The seller then confirmed receipt of the funds the next day.

The standard boat industry broker fee is 10%. Exploratory discussions with several different brokers had convinced me to offer Mimi initially at $220,000, based on market conditions. The current offering price of $202,000 reflects the elimination of the vast majority of this fee (there will obviously be a much smaller escrow services fee involved). This gives a much better value for just a little more legwork by the sellers and buyers.

1. Are you the current owners and/or are you using a broker?
* Yes - my wife and I are the sole owners.
* We do have a broker agreement (PopYachts) but the agreement allows me to sell the boat directly.

2. When were the pictures on the website taken? Is there an up-to-date walk-through video?
* Almost all the pics are recent (a small group - maybe 5 or 6 - are a little older - they're the staged ones, like the pic of the berth with the bed made up). The videos are all recent.

3. Why are you selling the boat? How long has it been on the market? Why was there a recent decrease in the price?
* Reason - my wife and I are moving inland for at least 6 years (new job) and won't have ready access to the boat.
* Mimi went on market in January 2018
* Price was decreased from $214,500 to $202,000 almost immediately. Original price was to enable me to move it to a broker (jump from $214k to $224K seemed easier than going from $202k to $224k (btw, the $202k number is what i think the true value of Mimi is)). After some good initial interest, I decided to abandon the broker direction, and moved the price to $202k.

4. What is the boat's history? Where was it during the last hurricane season?
* From 2005-2007 (3 yrs) original owners had Mimi in Sunsail charter in St Lucia.
* From 2008-2011, original owners (from US west coast) kept the boat in Grenada (Carribbean) and would use her 3 months each year (remaining 9 months Mimi was stored out of the water at a Grenada boatyard).
* We purchased in 2012 and moved her from Grenada to Charleston SC. We spent 2+ years living on Mimi, moving from Charleston down through the Keys, and then back to Myrtle Beach SC in 2015. Currently in North Myrtle Beach (Little River, SC).
* Last hurricane season she was in N Myrtle Beach. No hurricane activity up here at all.

5. How many owners has the boat had? Was it ever used as a charter boat? Or used for blue water cruising?
* We're the second owners.
* Mimi was in Sunsail charter her first 3 years.
* Original owners took her between some close proximity islands while in Caribbean. We've gone offshore on overnight trips only 3 or 4 times. Most of our activity has been on Intercoastal Waterway.

6. When was the boat last hauled out? What is the condition of the hulls? When was the bottom paint last redone? Are there any leaks, stress fractures, blisters, or areas of delamination? Are there any weak areas or bulges?
* Last hauled Sept - Dec 2017
* Hulls were tested with a moisture meter and did not show any problems.
* Bottom anti-fouling paint (Interlux) was applied end of Nov 2017
* No leaks, stress fractures, blisters, areas of delamination, weak areas or bulges. The salon top did have a significant number of non-structural, closed (not open or gaping) small cracks. All these were repaired, and the top repainted (except for non-skid surfaces), so the top looks brand new. BTW - these type of gelcoat cracks are very common with catamarans due the the dual-hull stresses put on the boat. Paint is a much more flexible coating than gelcoat, and should last much longer with normal maintenance.

7. Has the boat ever sustained any damage from hurricanes or otherwise? If so, what kind of damage was done and how was it repaired? How long ago? And who repaired it?
* No damage.

8. How many hours are on the engines? And how are they running? Have they recently been serviced? What condition are the sail drives in? Are there any leaks?
* 1850 hours on each engine. I had the engines serviced at the haul-out (late 2017). Replaced generator and starter on starboard engine, at recommendation of engine mechanic. Both have always run very well.
* I've had the sail drive bottom seals replaced (and lube changed) at each haulout (3 times since 2012), but the top seals are the originals. Starboard saildrive top seal had a small "seepage" when I first bought her in 2012, previous owner said he had seen same problem since he had her out of charter. It hasn't become worse over the years. I routinely check the saildrive fluid level before each engine start, and have only topped off the fluid a couple times.

9. When was the mast down last? What condition are the sails and rigging in?
* Standing rigging fully replaced during last haul-out - November 2017.
* Both sails taken to sail loft and cleaned, inspected and small repairs made. Both in good shape according to sail loft guy.

10. Are there any electrical issues that should be noted or dealt with? How does the solar, wind, and generator do keeping up with daily life power usage while at mooring?
* No open electrical issues.
* During our 2+ yrs liveaboard, when we were at anchor or moored, solar panels kept house batteries up to 100% charge each day. If there were successive cloudy, rainy days, I would occasionally attach a 1k watt portable generator (Yamaha) in the morning and run it 2-3 hrs to catch the house batteries back up. On board, we would run lights (all LED), 2 TV's, coffepot in morning, recharge electronics, fans, and solar kept up with it. BTW - all batteries (house and engine) were replaced during 2017 haulout 4 months ago.
* Currently, no wind generator or onboard generator.

11. How old are the electronics? What condition and how are the radar, auto-pilot, chart plotter, and etc. working?
* Original electronics - so 2004. We actually use an IPad that I have mounted at the helm, running Navionics app ($45/year i think). Same app runs on both our iphones as backup. VHF was replaced during haulout - it includes receive-only AIS. Chart-plotter has chip for East Coast and Carribbean, and works fine. Auto-pilot in good shape - never any problem. Auto-Pilot screen unfortunately did have it's cover blown off during 2016 and did some "sunburn" on the screen, but is still perfectly functional.

12. Any issues with the dingy or davits? Has the life raft been recently been serviced?
* Dingy / Davits are fine - New (2016) outboard.
* Life raft last inspected in 2011. Not needed for the style of cruising my wife and I did, so never saw the need.

13. In what country is she registered? Has US VAT been paid? How much is it insured for?
* Coast Guard registered - US.
* All US taxes are paid up-to-date. Non-liveaboard property taxes in SC runs about $1,900/year. When in liveaboard mode, we paid $400/year.
* Currently insured for $190k. Insurance runs us about $2,000 per year, and covers year-round all the way down thru the Keys and up to 100 miles offshore (which includes most of Bahamas).

14. Where is the boat currently? How much are slip fees? And how much is it to haul the boat on land?
* Mimi is in Little River, SC (right at SC / NC state border) at Coquina Harbor Yacht Club (marina).
* We pay $304/month for slip. Electrical hookup is available (and would be additional charge), but we don't use it since the solar meets the battery needs.
* I think the haulout at the Wilmington NC boatyard where I had repairs done was about $600 (haulout and splash total).

15. Has the boat recently been surveyed? Would you pay for a surveyor to come survey the boat? Would you haul the boat on land for the surveyor?
* Last survey performed was when I had Mimi surveyed when I purchased in 2012 - completed by a local surveyor in St Lucia. I'd be glad to send you a copy of that survey if you're interested.
* Survey and haul out fees would be the responsibility of the buyer.

16. When are you available to show the boat?
* Available almost anytime. I live about 20 minutes away from marina. I occasionally travel on business (maybe once per month), but can always work with your schedule with a little notice.
